General terms and conditions of use for the RTS Radio Télévision Suisse professional sales website, 1 December 2024

Acceptance of general terms and conditions

Any and all usage of the professional sales website (the "Website") of RTS Radio Télévision Suisse ("RTS") and the services offered by the same (such as archive viewing and listening facilities, etc.), is deemed to constitute prior acceptance by the user of the present General Terms and Conditions. In electing to use the Website, the User declares their acknowledgement and express and unreserved acceptance of the content of the present General Terms and Conditions. RTS reserves the right to amend the present General Terms and Conditions at any time without prior notice. It is therefore recommended that users regularly consult the latest version of the General Terms and Conditions, which is available at all times on the Website, www.RTSpro.ch.

1. Object

The present General Terms and Conditions set out the rules which apply to the use of the Website www.RTSpro.ch.

Within the meaning of the present General Terms and Conditions, the term "User" refers to all persons accessing and browsing the Website.

2. Use of the Website

The Website may be used solely to view programming by means of streaming. No material may be downloaded. The authorization of the sales service is required before any use is made of the content found on the Website.

The User bears full and sole responsibility for their use of the Website.

Consequently, RTS cannot be held liable under any circumstances for direct or consequential losses of any nature which might result from the use of, or any inability to use, the Website. Specifically, direct or consequential loss includes, but is not limited to, the loss of profits, clients, data, and tangible or intangible assets.

In particular, RTS is not liable under any circumstances for software function or for the transmission of any data or information via the internet, or if all or part of the Website is hacked into, and the loss that such hacking might cause to the User or to third parties.

In principle, the Website is available around the clock. However, RTS cannot be held liable if the Website cannot be accessed for technical reasons, whatever their origin (force majeure, maintenance work, content updates, network interruptions or failures, power cuts, technical failure, the incorrect configuration or usage of the User's computer or reception devices or telecommunications connections, or any other reason which may or may not be beyond the control of RTS).

The User bears the risk associated with all material obtained, by whatever means, from the usage of the Website. RTS cannot be held liable under any circumstances for damage or data loss sustained by the User in this way.

RTS offers no guarantee that the Website is free of viruses. Consequently, RTS cannot be held liable if the User's computer hardware becomes infected with a virus. The User is responsible for taking all of the measures necessary to protect their own data, software, computer and other hardware from contamination with any viruses which may be circulating on the internet.

Furthermore, RTS offers no guarantee whatsoever in respect of the rates of transmission and transmission times for data from the server which hosts the Website to the internet and the User's computer.

RTS reserves the right to modify or suspend, temporarily or permanently, all or part of the Website at any time without notice. Such modification or suspension does not give rise to any right of recourse, complaint or other claim of whatever nature against RTS.

The User is liable to RTS for all damage and loss of whatever nature that they cause by their use of the Website.

RTS issues Users with a login name and password to access to the Website. Users are not permitted to communicate these login details to third parties.

3. Intellectual property

RTS is the exclusive holder of all intellectual property rights to both the structure and the content of the Website, or has duly acquired the rights permitting the commercial exploitation of the structure and content of the Website.

In particular, all of the elements of the Website, in whatever format (text, images, sound, photographs, videos, music, data, logos, trademarks, software, etc.) are protected by intellectual property rights and are the exclusive property of RTS and/or its partners.

Consequently, any and all reproduction, representation, adaptation, modification, translation, conversion, broadcast, or integration into another website, whether for commercial or non-commercial purposes, and/or the reuse in whatever form of all or parts of the elements of the Website, is strictly forbidden without the prior written consent of RTS.

Visiting and browsing the Website does not confer upon the User any property rights or intellectual property rights to any of the elements of the Website.

Any and all unauthorized usage of any element of the Website (hacking, counterfeiting material, etc.) may result in legal action under civil and/or criminal law and to claims for the payment of damages.

4. Liability

Despite the great care that is taken in setting up and updating the Website, RTS cannot offer any guarantee of the correctness of the information it contains.

Consequently, notwithstanding the mandatory liability provisions of Swiss law, RTS cannot be held liable for any errors, inaccuracies or omissions, or for any direct or consequential loss of any nature which may result from visiting and/or using the Website.

RTS cannot be held liable if the words or images contained on the Website might offend certain particularly sensitive individuals.

6.  Applicable law and place of jurisdiction

The present General Terms and Conditions are subject to Swiss law.

The courts of Lausanne (Switzerland) constitute the sole place of jurisdiction in the case of dispute.
