Offense Of Solidarity

Any person assisting or attempting to assist the unauthorised entry of a foreigner in the EU is liable for prosecution. This "crime" has a name: the offense of solidarity. In theory, European legislation bears an exemption for those providing humanitarian or selfless acts to migrants. Yet the exception is respected only by 8 European countries out of all member states. For all the other countries, the  actual implementation of the law does not distinguish between those acting on selfless and humanitarian grounds from professional smugglers exploiting human misery. The same is true in Switzerland, where courts handed down very severe sentences, without however hindering the smuggling business. Our journalists report from Switzerland and France on a policy of setting target figures, where the ethics of law and justice seems to have been lost along the way.
